Acceptance of Terms:

By accessing this website and placing an order, you agree to the following terms and conditions:

1. Eligibility – You must be at least 18 years old and a resident of a country where we ship. You must have the legal capacity to enter into binding contracts under the laws applicable in your country of residence. 

2. Products – We make every effort to ensure product descriptions, images and prices are accurate. However, slight variations in packaging or appearance may occur. Results from cosmetic or hair care products may vary from person to person. Customers are advised to perform a patch test before use. Our cosmetic products comply with Regulation (EC) No 1223/2009 on cosmetic products applicable within the European Union.

All cosmetic claims comply with Regulation (EU) No 655/2013 laying down common criteria for cosmetic claims and are supported by appropriate evidence as required under EU law.

Cosmetic products are intended to maintain or improve the appearance of hair and scalp. Results on hair growth may vary from person to person. 

The essential characteristics of each product are described on the individual product page prior to purchase, including composition, function, precautions for use, and volume.

The products sold on this website are cosmetic products. They are not intended to diagnose, treat, cure, or prevent any disease.

A Responsible Person established within the European Union has been designated in accordance with Article 4 of Regulation (EC) No 1223/2009.

All cosmetic products sold are notified on the Cosmetic Products Notification Portal (CPNP) in accordance with Regulation (EC) No 1223/2009 prior to being placed on the EU market.

The designated Responsible Person established within the European Union can be identified on the product packaging in accordance with Article 19 of Regulation (EC) No 1223/2009.

Product descriptions and marketing statements are based on supplier information and cosmetic product documentation. No medical claims are made.

Products are sold exclusively to consumers for personal use.

The seller does not provide medical advice. Information available on this website is provided for cosmetic and informational purposes only and does not substitute professional medical consultation.

Cosmetic Products – Proper Use & Medical Disclaimer

The products offered on this website are cosmetic products within the meaning of applicable European legislation and are intended exclusively for external use.

They are not medicinal products and are not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to hair loss disorders, dermatological diseases or hormonal conditions.

Proper Use

Customers must strictly follow the instructions for use provided on the product packaging and on the website.

The Company shall not be held liable for any damage, reaction or undesirable effect resulting from:

• Use contrary to instructions,

• Excessive or inappropriate application,

• Combination with incompatible products or treatments,

• Use on irritated, injured or pathological scalp conditions,

• Failure to conduct a prior sensitivity test where recommended.

Customers are solely responsible for verifying that the product ingredients are compatible with their personal sensitivities or known allergies.

Variable Results Disclaimer

The effects of cosmetic products may vary depending on individual factors, including but not limited to:

• Genetic predisposition,

• Hormonal profile,

• Age,

• Lifestyle and diet,

• Consistency and duration of use,

• Pre-existing scalp or hair conditions.

As such, no specific result, performance level or time frame is guaranteed.

Any testimonials, before-and-after illustrations, or customer reviews presented on the website reflect individual experiences and do not constitute a guarantee of identical results.

No Medical Advice

Information provided on this website, including product descriptions, blog content, educational materials or customer support responses, is provided for informational purposes only.

It does not constitute medical advice, a diagnosis or treatment recommendation.

Customers experiencing significant or persistent hair loss, dermatological symptoms or medical conditions are advised to consult a qualified healthcare professional.

Contractual Seller

KÓMĒ Hair Growth acts as the contractual seller of all products offered on this website. Certain logistical operations, including storage, shipping, and returns, may be carried out by independent third-party suppliers established within the European Union. This does not affect the consumer’s statutory rights.

The seller remains fully responsible towards the consumer for the proper performance of the contract in accordance with Article 3 of Directive 2011/83/EU.

All third-party suppliers involved in the fulfillment process are established within the European Union and comply with applicable European product safety and cosmetic regulations.

3. Shipping – Orders are processed within 7 business days.

Delivery times are estimates and may vary depending on location.

While we strive to meet estimated delivery times, delays may occur due to circumstances beyond our control. This does not affect the consumer’s statutory rights.

In accordance with EU consumer law, the risk of loss or damage to the goods transfers to the consumer only when the consumer or a third party designated by the consumer takes physical possession of the goods.

If we fail to deliver within the agreed timeframe, the consumer may require delivery within an additional period appropriate to the circumstances. If delivery is not made within that additional period, the consumer shall be entitled to terminate the contract. 

Incorrect address provided by customer

If the parcel cannot be delivered due to an incorrect or incomplete address provided by the customer, the customer may be responsible for additional shipping costs required to resend the parcel.

Damaged packages

If the parcel is received damaged, the customer must notify us within 48 hours of delivery and provide photographic evidence of:

• The outer packaging

• The shipping label

• The damaged product

Failure to report visible damage within this timeframe may affect our ability to process the claim with the carrier.

Responsibility and risk transfer

In accordance with EU consumer law, the risk of loss or damage to the goods transfers to the consumer only when the consumer, or a third party designated by the consumer, takes physical possession of the goods.

If the carrier confirms that the parcel was not delivered or has been lost in transit, we will, at the consumer’s choice:

• Reship the products at no additional cost, or

• Issue a full refund using the original method of payment

Confirmed delivery by carrier

If the carrier provides proof of delivery to the address indicated by the customer at the time of order, including delivery confirmation or signature where applicable, the order shall be considered fulfilled.

In such cases, we may assist the customer in filing a claim with the carrier, but we cannot be held responsible for loss resulting from incorrect delivery information provided by the customer.

Electronic signatures are considered valid proof of delivery.

Lost, undelivered or damaged packages:

If the customer has not received their order within the estimated delivery time, they must contact our customer service at:

within a reasonable time after the expected delivery date.

Investigation procedure

Upon notification, we will initiate an investigation with the carrier in order to determine the location and delivery status of the parcel.

The customer may be required to:

• Confirm the delivery address provided at checkout

• Verify that no delivery notice was left

• Confirm that the parcel has not been received by a household member, neighbor or designated third party

Where appropriate, we may request a signed declaration confirming non-receipt of the parcel.

4. Right of Withdrawal (EU Customers)

In accordance with EU consumer law, customers have the right to withdraw from their purchase within 14 days of receiving the product.

Consumers are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

In accordance with Article 16(e) of Directive 2011/83/EU, sealed goods which are not suitable for return due to health protection or hygiene reasons are not eligible for return if they have been unsealed after delivery.

The return address may vary depending on the product supplier. The applicable return address will be clearly communicated to the consumer prior to the conclusion of the contract and again in the order confirmation email.

The customer shall bear the direct cost of returning the goods unless otherwise agreed.

Refunds will be issued within 14 days after we receive the returned goods or proof of return shipment.

5. Limitation of Liability 

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of this website or the purchase of products, including but not limited to:

• Loss of profits or revenue

• Loss of business opportunity

• Loss of anticipated savings

• Loss or corruption of data

• Business interruption

• Reputational damage

The Company shall not be held responsible for:

• Temporary or permanent website unavailability

• Technical errors, bugs or interruptions

• Cyberattacks, hacking, malware, viruses or distributed denial-of-service (DDoS) attacks

• Internet network failures beyond our control

• Errors resulting from the customer’s device, browser or internet connection

The Company does not guarantee that the website will be uninterrupted, secure or error-free at all times.

With regard to products, the Company shall not be liable for:

• Improper use, misuse or modification of products

• Use contrary to provided instructions

• Allergic reactions where ingredients were clearly disclosed

• Results not meeting subjective expectations

Nothing in these Terms shall exclude or limit liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any liability that cannot be excluded under applicable consumer protection laws within the European Union

In any event, the Company’s total aggregate liability shall be strictly limited to the total amount paid by the customer for the order giving rise to the claim.

Force Majeure – We shall not be held liable for any delay or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, or governmental actions.

Pre-Contractual Information (EU Consumer Rights Directive 2011/83/EU)

In accordance with applicable European Union consumer protection legislation, the following information is provided to customers prior to the conclusion of any purchase contract:

1. Prices

All prices displayed on this website are indicated in Euros (EUR) and include all applicable taxes, including Value Added Tax (VAT), unless otherwise stated.

Any additional charges, where applicable, will be clearly indicated before the customer confirms the order.

2. Currency

All transactions are processed in Euros (EUR). If payment is made in another currency, the applicable exchange rate and any additional bank charges are the responsibility of the customer.

3. Shipping Costs

Shipping fees are clearly displayed at checkout before the order is finalized. The total price, including shipping costs and any applicable taxes, is shown prior to payment confirmation. Delivery is only available to EU countries.

4. Accepted Payment Methods

We accept secure payments via approved third-party payment providers, including:

• Credit and Debit Cards, Apple Pay,

• Secure online payment processor Stripe.

All payments are processed through encrypted and secure systems.

5. Delivery Timeframe

Orders are processed within 7 business days.

The maximum delivery timeframe within the European Union shall not exceed 30 calendar days from the date of order confirmation, unless otherwise expressly agreed with the customer.

6. Legal Guarantee of Conformity

All products sold on this website are covered by the legal guarantee of conformity in accordance with EU consumer protection law.

Consumers are entitled to at least two (2) years legal guarantee from the date of delivery. In the event of lack of conformity, consumers have the right to request repair, replacement, price reduction, or refund under the conditions provided by applicable law.

This legal guarantee applies independently of any commercial warranty that may be offered.

Online Dispute Resolution 

Consumers have the right to lodge complaints with their local consumer protection authorities. 

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

These Terms are concluded between the consumer and LAVIGNE MARIE SEBASTIEN FOMABRON OE, trading as KÓMĒ Hair Growth, registered in Greece under number 802539273.

7. Professional Invoices

Professional invoices (business invoices) may only be issued after the expiration of the statutory withdrawal period of fourteen (14) days, in accordance with applicable EU consumer protection laws.

Such invoices will be issued within a maximum period of fourteen (14) days following the end of the withdrawal period, upon request and exclusively to professional customers.

The issuance of a professional invoice is subject to prior verification of the tax identification details provided by the customer. In the event that the information is incomplete, incorrect, or cannot be validated, no professional invoice shall be issued.

In the event of confirmed fraudulent activity, the Company reserves the right to:

• Refuse future orders,

• Initiate appropriate legal action,

• Share relevant information with payment providers or authorities when required by law.

Any abusive claim, false declaration, or bad-faith dispute may result in the permanent suspension of the account.

Right to Refuse or Cancel Orders

The Company reserves the right to refuse or cancel any order for legitimate reasons, including but not limited to:

• Product unavailability,

• Pricing errors,

• Suspected fraud,

• Abnormal or excessive order quantities,

• Violation of these Terms.

In the event of cancellation prior to shipment, the customer will receive a full refund via the original payment method.

Non-Resale Clause

Products purchased on this website are strictly intended for personal use only.

The resale, redistribution, or any commercial exploitation of the products without prior written authorization from the Company is prohibited.

The Company reserves the right to cancel any order or restrict future purchases in the event of suspected unauthorized commercial resale.

Governing Law & Jurisdiction:

This clause does not deprive consumers of the protection granted to them by the mandatory provisions of the law of their country of residence, nor of their right to bring proceedings before the competent courts of the Member State in which they reside.

These Terms are governed by Greek law, and any dispute shall be submitted to the competent courts of Athens, Greece.
